#### 1.9.4 Digital Ballots and Auditing (When Electronic Voting Is Permitted)
**Purpose:** Ensure secure, transparent, and trustworthy handling of electronic ballots for elections, bylaw amendments, or other member votes when allowed by the Bylaws and applicable New Mexico law.

**Requirements:**
- **Audit Oversight:** All digital ballots must be distributed, collected, and certified under the supervision of an independent <strong>Auditing Committee</strong> appointed by the President and confirmed by the Board.
- **Eligibility Controls:** The Auditing Committee must verify voter eligibility (active membership, good standing) and maintain a distribution list separate from the vote-tally database.
- **Ballot Tokens:** Each eligible voter receives a unique, single-use ballot token; tokens are tracked for use/receipt but never tied to ballot selections.
- **Separation of Identity and Choice:** Systems and procedures must ensure that a member’s identity cannot be linked to their vote choice by any single person acting alone.
- **Dual Control:** At least two Auditing Committee members jointly open/close voting, access tallies, and produce the certification report.
- **Anonymity Requests:** When anonymity is requested by the Board or required by the vote type, ballots must be administered and certified by a <strong>third‑party auditing entity</strong> (external to PMTNM’s Board and candidates). The third party provides a signed certification report and preserves chain of custody.
- **Conflicts of Interest:** Candidates or sponsors of measures being voted on may not serve on the Auditing Committee, nor have access to interim tallies.
- **Retention & Privacy:** Maintain auditable system logs and final certification reports for at least 3 years without storing any link between a voter’s identity and their ballot selection.
- **Accessibility & Deadlines:** Provide accessible voting interfaces, clear deadlines, and a help contact. Offer alternate reasonable accommodation upon request.
- **Tamper Detection:** Use basic tamper controls (token invalidation after use, IP/rate monitoring as feasible, anomaly review by the Auditing Committee).

The following Tier 2 standards are recommended to achieve consistent, professional operations beyond the legal minimum. While not bylaws-level mandates, the Board should adopt these as <strong>operating regulations</strong> (by motion) to guide continuity and quality. Chairs should maintain brief one-page procedures to ensure year-to-year handoffs.
